But people might sue

The Detroit News opposes Proposal 2 because of potential lawsuits targeting women’s health programs. In California, similar lawsuits were filed but dismissed and women’s health programs continue to operate.

Immediately following passage of the Civil Rights Act of 1964, several states challenged its constitutionality but were rejected by the Supreme Court in South Carolina v. Katzenbach. Just out of curiosity, did the News oppose the Act because of potential lawsuits?
